Legal Notice
These conditions establish the terms and conditions under which Aviate will govern the provision of services through access to it's website, www.aviate.pt or telephone 300 501 935, where you can order products and/or services made available under the terms and conditions described here.
When placing the order, the products and/or services the customer agrees and is bound by the terms defined in these terms and conditions.
The information provided to place the order is governed by the privacy and cookies policy.
Orders can only be placed by customers aged eighteen or over, or with the authorization of their representatives for under age.
If the customer disagrees with the terms and conditions expressed here, they should not use any of the means provided, being, however, unable to place their order.

What we do
Aviate provides the customer with the means, electronic or telephone, to order products and/or services from partners that will deliver to the address indicated when ordering, through distributors.
Means
The customer can access some areas of the website, without having to place an order or register their personal data.
When creating the customer record, you will be asked to provide personal information, such as name, email address, phone number and address. It is the customer's responsibility to ensure that this information is real and current.
The form can also be created by phone and in this case the customer receives an email to validate the information provided.
When executing the client file, you will be asked to create a password. The customer is responsible for keeping this password secure, for all use and activity performed under their access data. The password will always be requested when completing the order.
Aviate tries to ensure that the website and the telephone contact, are always operational, but does not assume any obligation to do so, and cannot be held responsible if they are not available.
Access to ordering means can be temporarily suspended at any time and without prior notice.
How to order:
Website
The customer chooses the partner and selects the products and/or services that he wants to buy from the respective list, he can finalize the order by clicking or selecting the option “confirm order”. The next step is to login or register, if you have not already done so, and you must select or add the delivery address, payment method, delivery date and time and billing data. It is important that the customer checks all information and corrects any errors before finalizing the order. To finalize the order the customer will have to enter his password, and click or select the option "Order". The order is placed and Aviate will start processing the order.
Telephonic service
The customer must indicate his data to the operator, so that his file can be accessed, or if it does not exist, proceed with its creation. You will need to provide the delivery address, and select the products and/or services you want to order, payment method and the date and time of delivery. The order is placed and Aviate will start processing the order.
Regarding the creation of the form, the client will receive an email to validate the data provided.
Requests
In some partners, a minimum order value may be defined. The customer will not be able to submit an order until its value is greater than or equal to the defined minimum value (excluding any delivery fee).
Qualquer alteração ou cancelamento do pedido, terá o tempo máximo de 5 (cinco) minutos após a realização da encomenda e está sujeita à aprovação por parte do parceiro. O Aviate não garante que o parceiro aceite, o cliente terá de proceder ao pagamento do pedido efetuado na eventualidade de não aceitação.
Orders can be made to more than one partner within the same geographic area, for this you must request the inclusion of another partner in the order.
The delivery times indicated are of course estimates, and are influenced by different external factors, which may suffer some changes. Aviate cannot be held responsible for non-compliance with the indicated delivery times.
Prices and Fees
The prices quoted include VAT, and the local delivery charge. Outside the locality, the respective delivery fee will be displayed, which varies depending on the address and location of the partner.
Payment
Payment can be made at the time of ordering through the mbway application or at the time of delivery by ATM, cash or using the mbway application.
Invoices are sent, exclusively via email, to the email address indicated for that purpose, or in the absence thereof, to the email address used in the registration.
Complaints or suggestions
Any suggestions or complaints can be made directly with our telephone service team, directly on the website or through the available complaint book.
The assessment that the client publishes will be considered non-confidential and will not be owned. The customer agrees that Aviate can and is free to use the assessment for any and all commercial or non-commercial purposes.
Website information
Aviate will do everything possible so that the information presented does not contain errors or omissions, and will be quickly corrected whenever they occur. Aviate can make the necessary changes at any time without notice.
We transcribe the information received from our partners and try to be precise with regard to the name of the articles, descriptions, prices, offer information, and warnings about allergies and other information. The partners are responsible for providing this information and guarantee that it is factually accurate and up to date, and Aviate does not assume any responsibility. If the customer is in doubt about allergy warnings, the content of a dish or any other product or information, he must confirm with our team.
The images presented on the website are merely illustrative and may not correspond and represent in full the product ordered, not being the responsibility of Aviate, if this occurs.
By using the ordering means the customer accepts that the communication will be mostly electronic. For contractual purposes, the customer agrees to these electronic means of communication and acknowledges that all contracts, notifications, information and other communications that Aviate provides electronically, meet the legal requirement that such communications be made in writing. This condition does not affect the client's legal rights.
Aviate will not be responsible for any failure to perform, or delay in complying with, any of its obligations under these terms, which are caused by events beyond reasonable control (“Force Majeure Event”).
Applicable law and jurisdiction
These terms and conditions are governed and interpreted in accordance with Portuguese law. Disputes or complaints arising will be submitted to the exclusive jurisdiction of the Portuguese courts, and a complaint may be filed through the Electronic Complaints Book at https://www.livroreclamacoes.pt/inicio
